The welfare and safety of children is a top priority during Family Court proceedings, especially where there are concerns surrounding a parent or guardian’s substance misuse.
In these circumstances, drug testing plays a critical role in assessing parent/guardian fitness, allowing authorities to make informed decisions about custody, contact arrangements, and safeguarding measures.
While a single drug test may provide a snapshot of a person’s substance use, it cannot reveal whether misuse is ongoing or if there is a risk of relapse.
This is where repeat drug testing comes into its own.
By monitoring substance use over a defined period, repeat testing enables the court/authorities to better understand patterns of behaviour, assess compliance with court orders, and protect the wellbeing of any children involved.
In this article, we explore how repeat drug testing is used in Family Court and the different types of drug testing available.
How is drug testing used in Family Court?
Substance abuse/misuse can significantly impair a parent or guardian’s ability to provide a safe and stable environment for a child.
In Family Court cases, any evidence of drug use – past or present – can raise serious concerns about a parent’s capacity to care for their children and may result in court-ordered interventions.
Drug testing is commonly requested by the court when:
- There is a history of drug or substance dependency
- Concerns have been raised by the other parent, child protection services, or other professionals involved in the child’s care
- A parent is seeking to regain custody or secure access rights, but must demonstrate they are drug-free
- Ongoing monitoring is needed to ensure continued abstinence from drugs
However, in many of these circumstances, a one-off drug test is simply not enough to provide a complete picture of a parent or guardian’s substance use.
This is where repeat drug testing provides considerable benefits, offering a reliable means of monitoring behaviour over time and, in turn, supporting decisions that prioritise child welfare.
Repeat testing allows the court/authorities to:
- Monitor for relapse: detecting any recurrence of drug use that could put a child at risk
- Demonstrate compliance: providing documented evidence that a parent is adhering to court-imposed conditions
- Support accountability and rehabilitation: helping parents demonstrate their commitment to recovery and build trust with professionals and family members
Types of drug testing available for Family Court
A variety of drug testing methods are available for use in Family Court proceedings, with each method offering its own advantages depending on the specific circumstances of the case.
Key factors that authorities need to consider when choosing the most suitable drug tests include:
- Why the test is needed i.e. to monitor for relapse/demonstrate compliance
- How far back drug use needs to be detected
- Whether repeat testing is required
- The type of substances that need to be tested for
Drug tests that can be used to obtain evidence for Family Court include:

Hair Drug Testing: also known as hair strand testing or hair follicle testing, this type of testing is considered the gold standard in toxicological analysis. For this test, a sample of head hair or body hair is collected and analysed for the presence of drugs and their metabolites (breakdown products).
It is possible for drugs to remain detectable in a cut hair sample for up to 12 months. Segmented analysis can also be performed for head hair depending on the length of hair available. This involves segmenting the hair into 1cm sections for a month-by-month profile of drug use. This type of analysis is useful if you need to identify a trend in drug use such as an increase or decrease over time, or to highlight intermittent use.

Nail Drug Testing: this test is ideal for circumstances where hair testing is not possible, such as where the donor has little or no hair, for religious reasons, or for those concerned with their appearance.
The test works by analysing fingernail clippings or toenail clippings for the presence of drugs and their metabolites, with fingernail clippings providing an overview of up to 6 months for historic drug use, and toenail clippings providing an overview of up to 12 months. This is because fingernails and toenails grow at different rates.

Oral Fluid Drug Testing: a form of narrow-window (short-term) drug testing, oral fluid testing works by analysing a sample of saliva for the presence of drugs and their metabolites. The test detects very recent drug use (up to approximately 48 hours after drugs were first consumed) offering immediate insight into substance misuse.
Non-invasive and easy to administer, with no special facilities required, oral fluid testing is ideal for on-the-spot testing and is routinely used for monitoring compliance in real time, especially where timely decisions need to be made about a child’s welfare (e.g. emergency care orders/interim care orders). It can also be used to complement hair or nail drug testing, providing a full picture of substance use.

Urine Drug testing: commonly used for ongoing, repeat testing to monitor abstinence or compliance, this test works by analysing a urine sample for the presence of drugs and their metabolites. As with oral fluid testing, urine drug testing provides what is known as a narrow window of detection, with drugs remaining detectable in a urine sample up to approximately 4 days after consumption.
Urine drug testing can also be used to complement hair or nail drug testing for a much more detailed picture of an individual’s long and short-term drug use.
